Definitions

In this Contract the following words and expressions have the following meanings unless inconsistent with the context: “The Acknowledgement” means the written confirmation of Your booking provided by W&G Harrison Limited, trading as Ribby Hall Village (company number 01032929) whose registered office is at Ribby Hall Village, Ribby Road, Wrea Green, Preston, Lancashire, PR4 2PR (“RHV”) to You in writing (including email); “The Client” or “You” means the person(s) named as the client on the Acknowledgement; “The Contract means the contract between RHV and You comprised of these terms, the contents of the RHV brochure and information on RHV's website current at the date of booking and any of RHV's promotional literature You have sought to rely upon at the time of booking and the Acknowledgement; "Dangerous Dog" means Pit Bull Terrier, Japanese Tosa Dogo Argentino, Fila Brazilieros or any other breed deemed as being dangerous under the Dangerous Dogs Act 1991 (as amendedor re-enacted from time to time) or by RHV from time to time; “The Deposit" means the non refundable sum paid by You to RHV at the time of booking; “The Holiday Price” the full price of the stay at The Village as quoted in the RHV brochure current at the date of booking, which may be amended from time to time by RHV; “The Reservation Form” means the form completed by You at the time of checking in or following receipt of the Acknowledgement; and “The Village” means RHV and all its grounds, owned by RHV. The headings in these Terms are for convenience only and shall not affect their interpretation.

The Contract

Your booking is an offer to RHV and no legally binding contract shall exist between You and RHV until RHV has received Your Deposit in cleared funds and RHV has issued the Acknowledgement containing Your booking reference number. You may cancel this Contract in accordance with the "Cancellations" provisions set out below. The Contract applies to Your stay at The Village. Any changes or additions to the Contract or to these Terms or the details in the Reservation Form must be agreed in writing between You and RHV. You are responsible for ensuring that each member of Your party complies with this Contract and all appropriate laws and bylaws and You shall be responsible for any breaches of the Contract or such laws or bylaws by any members of Your party, whether they are staying at The Village or are day guests. RHV reserves the right at its absolute discretion to cancel Your booking or instruct You or Your party to leave The Village immediately, without compensation or refund, should You or any member of Your party not comply with the terms of the Contract. You confirm that all information provided by You on the Reservation Form or otherwise is complete, true and accurate in all respects. Once complete, the Reservation Form shall be incorporated into the Contract.

Prices & Payments

All tariffs are inclusive of VAT which will be charged at the applicable rate in force from time to time. The price includes Your right to use all facilities at The Village listed as FREE in the RHV brochure current at the time of booking, for the use of all other facilities at The Village additional charges apply. A Deposit of £75 is required to secure Your booking, excluding Christmas and New Year breaks, where a £250 deposit is required. Deposits can only be made by credit or debit card or RHV vouchers. Should You decide to pay by credit card an additional 2% of each transaction will be charged. Payment of the balance of the Holiday Price shall be paid in full no later than 6 weeks prior to Your arrival at The Village. Please note that reminders will not be sent. If the balance of the Holiday Price is not received by RHV in full at least 6 weeks prior to Your arrival, RHV reserves the right to terminate the Contract and treat Your booking as having been cancelled without further notice to You. The Deposit will not be refunded. For reservations made within 6 weeks of arrival, payment of the Holiday Price is required in full at time of booking. RHV reserves the right to invoice You (or recover the cost from the payment details which You provided upon payment of the charges to RHV) for the cost of remedying any breach of this Contract.

Villanova, The Coach House and The White House

All the terms above apply to You booking The Coach House and The White House other than where the provisions below are inconsistent, in which case, the following clauses shall apply.

Deposits

A non-refundable deposit of £250 is required to secure Your booking. The remaining balance is to be paid no later than 6 weeks prior to Your arrival, otherwise RHV reserves the right to terminate the Contract and treat the booking as cancelled without further notice to You.

Dog-Friendly Cottages

Your booking of a dog-friendly holiday cottage is subject to certain expectations and You hereby agree and acknowledge that unless otherwise agreed in writing by RHV, the only pet RHV permits You to bring to The Village is a dog and that You may only bring one dog with You. By making a booking You warrant that your dog is not a Dangerous Dog and that You shall not bring a Dangerous Dog to The Village. There are only a limited number of dog-friendly holiday cottages available and therefore Your ability to secure a dog-friendly holiday cottage is subject to availability. In making a booking for a dog-friendly holiday cottage You take on all personal health risks in respect of any allergies, which You may suffer from and understand that numerous different dogs may have stayed in the holiday cottage prior to Your stay. Whilst RHV makes every effort to clean each holiday cottage prior to Your stay, to the extent that it is able to do so, RHV shall not be liable for any allergies or health consequences that You suffer from when staying at a pet-friendly holiday cottage. 

Arrival & Departure

You are welcome to arrive and use RHV's facilities that are included within Your Holiday Price from 12 noon on the day of arrival. RHV aims to have Your accommodation ready for Your arrival by 4pm. To ensure efficiency of RHV's checking in procedure, keys should be collected by 1 person only per party from our holiday guest reception on presentation of Your Acknowledgement. If You are likely to arrive after 8pm, please telephone 01772 671111 so that RHV can make alternative arrangements for You to check-in to Your accommodation. Your accommodation must be vacated and keys returned to the main holiday reception by 10am on the day of departure and RHV reserves the right to charge You an additional fee of £25 for every hour (or part of an hour) for which You are late in vacating Your room as compensation for not being able to ready this for the next guests due to arrive. For the avoidance of doubt You shall be deemed to be an hour late if You are 1 minute late. You are however welcome to use all other RHV facilities that are included within Your Holiday Price on Your day of departure up to 4pm. Guests wishing to use any additional RHV facilities will be subject to additional charges.

Amending Your Booking

Please call RHV immediately quoting Your booking reference number if You wish to amend Your booking. RHV will use reasonable endeavours to make the necessary amendments to Your booking and if able to do so shall forward You a revised Acknowledgement. RHV reserves the right to charge a £25 administration fee per booking change. Where RHV is unable to amend Your booking and You wish to cancel Your reservation, please refer to the "Cancellations" section below. Deposits are non refundable.

Our Right to Decline

RHV reserves the right to ask for information about any member of Your party including age, name, email, tel. no., any medical conditions and address details and in the case of dogs, the relevant breed of dog, medical conditions, medical history and such other pieces of information of which RHV deems it relevant to be aware. You warrant that You have obtained the express consent of the member of Your party whose personal data or sensitive personal data You disclose to RHV in accordance with this section and that You shall at all times comply with the provisions of the Data Protection Act 1998 ("the DPA"). RHV reserves the tight to decline bookings including but not limited to adult only and same sex groups including hen and stag parties and where groups of individuals are under the age of 21 years. If You or a member of Your party has had an infectious or contagious medical condition within 4 weeks of Your stay, or during Your stay You may also be asked to refrain from partaking in certain activities or You may be asked to leave The Village, should RHV deem it necessary to protect the health and safety of other guests and staff. RHV reserves the right to refuse admission, or to deny the continued occupation of any type of accommodation, for whatever reason, at its sole discretion and without prejudice to RHV's rights to retain sums that have been paid.

Behaviour & Compliance with this Agreement

RHV is a family holiday village and it asks that Your behaviour and attire reflect this. Your behaviour should not be excessive, noisy or disruptive. Offensive or illegal behaviour will not be tolerated, and could lead to Your eviction and police involvement. You must show consideration for Your neighbours and other guests. You agree and acknowledge that You shall indemnify RHV, keep RHV indemnified and hold RHV harmless for any compensation RHV may reasonably pay to its other guests as a result of Your actions. No refunds or compensation will be given to You in these circumstances and RHV reserves the right to refuse any future bookings from You or a member of Your party without liability. RHV reserves the right to invoice You (or recover the cost from the payment details which You provided upon payment of the charges to RHV) for the cost of remedying such a breach of this Contract.

Cancellation

The Deposit is a booking fee, which will be forfeited if a booking is cancelled. Under no circumstances will the Deposit be refunded or transferred. In the event of the booking being cancelled after the balance of the Holiday Price has been paid, and within six weeks of Your arrival You will be liable for the entire Holiday Price and no part of the Holiday Price paid will be refunded. Where cancellations are received more than six weeks prior to Your scheduled arrival You shall only be liable for those payments already made by You to RHV, which for the avoidance of doubt RHV shall not refund. Other than in circumstances in which RHV is entitled to treat Your booking as cancelled, all cancellations must be put in writing and notified to RHV immediately. RHV's prices do not include cancellation insurance cover. RHV advise You to take out Your own personal cancellation insurance.

Your Dog - Your Particular Attention is Drawn to this Clause 

When making a booking for a pet friendly holiday cottage and attending The Village, You warrant that Your pet: (a) has at the very least received an annual vaccination for distemper, canine hepatitis, leptospirosis, parvo virus and any other vaccination required by RHV from time to time and that it is free from any illnesses, viruses, parasites, fleas and infections; (b) will be supervised by You at all times throughout Your stay at The Village, ensuring that whenever it is outside of Your holiday cottage, Your pet shall be kept on a lead; (c) will not be or cause a nuisance or threat to any other users of The Village including RHV staff and contractors; (d) will be kept in a secure place either in an alternative room or outside of Your holiday cottage, away from RHV’s staff or contractors whenever they are required to attend Your holiday cottage during Your stay at The Village and that in such circumstances You shall at all times comply with any requests made by RHV staff or contractors; (e) will not be taken into any building other than that which RHV has permitted You to take it, namely Your holiday cottage; and (f) shall use only the designated toilets or fouling areas notified to You by RHV and that You shall immediately pick up any foul in a plastic bag and place it in the available designated bins.

RHV's Considerations About Your Pet

Where RHV, acting in its absolute discretion, deems that You have or are reasonably likely to breach any of the warranties provided by You in the “Your Pet” section above or that Your pet is a Dangerous Dog, it may without liability to refund or compensate You whatsoever, order You to: (a) remove it from The Village; (b) leave The Village completely; For the avoidance of doubt, where You decide to put Your pet in kennels and continue with Your stay at The Village, You shall do so at Your own expense and risk.

Assistance Pets 

Registered assistance dogs are not classed as pets for the purposes of this Contract and are allowed in the majority of the parts of The Village.

Special Requirements & Disabilities

RHV welcomes guests with restricted mobility, disabilities, and medical or particular care requirements and aims to ensure that its services are as accessible as reasonably possible so it is important that You make RHV fully aware of any special needs, requirements and conditions prior to RHV issuing the Acknowledgement in order that availability, suitability and potential reasonable adjustments may be discussed. This may include any requirement for a guest to be accompanied by someone who is able to provide any particular needs they may have over and above any reasonable adjustments RHV is able to make. A risk assessment may also be required prior to confirming the Acknowledgement or allowing participation in certain leisure activities. RHV relies on the information You provide to help it anticipate and satisfy Your needs. You must therefore keep RHV informed as to any change in circumstances prior to and during Your stay. Standard Wheelchair access only is available and RHV has only one adapted cottage.

The Media

Members of the press or media are not to be invited onto The village premises without RHV's express written permission. You may not use photographs of RHV staff without the written consent of RHV.

Filming & Photography

RHV does not allow any filming or photography in or around the swimming pools and changing areas. RHV sometimes takes photographs and films for promotional and training purposes which may take place during Your stay. By making a booking You agree that RHV may use any such photographs and films in which You are captured for these purposes.

Data Protection

Information provided when booking will only be used by RHV in accordance with the DPA and this will not be passed to any third parties. You consent to RHV providing You from time to time with details of RHV's new facilities or special offers by post. If at any time You wish to be removed from RHV's mailing lists please write to: The Marketing Department, Ribby Hall Village, FREEPOST NWW29I4A, Preston, Lancashire, PR4 2ZZ.

Care Of Your Possessions

Information provided when booking will only be used by RHV in accordance with the DPA and this will not be passed to any third parties. You consent to RHV providing You from time to time with details of RHV's new facilities or special offers by post. If at any time You wish to be removed from RHV's mailing lists please write to: The Marketing Department, Ribby Hall Village, FREEPOST NWW29I4A, Preston, Lancashire, PR4 2ZZ.

Fishing

In order to fish at The Village, those over the age of 12 years must hold a valid English fishing rod licence and present it to a RHV representative upon request. RHV reserves the right to prohibit anyone who does not hold a valid fishing licence from fishing at The Village. For guests wishing to fish at Fisherman's Reach or Condor Green, passes are available to purchase on arrival. Prices are available on request. Please be aware that ponds are subject to annual maintenance. Guests purchasing a pass are asked to review RHV's fishing rules in Your in-cottage guide. Please note that fishing rules may vary between England and other parts of the United Kingdom.

Liability

Nothing in the Contract shall exclude or in any way limit RHV's liability for fraud, fraudulent misrepresentation, or for death or personal injury caused by its negligence, or any other liability to the extent that such liability may not be excluded or limited as a matter of law. Subject to RHV's maximum aggregate liability under or in connection with the Contract, whether in contract, tort (including negligence) or otherwise, will in no circumstances exceed the total charges payable to RHV for Your holiday. RHV will not be liable under the Contract for any special, indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise, whether or not such loss or damage is foreseeable, foreseen or known. The Contract states the full extent of RHV's obligations and liabilities to You arising out of or in connection with this Contract and You agree that any condition, warranty, representation or other term concerning the Contract which might otherwise be implied into or incorporated in the Contract, whether by statute, common law or otherwise, is excluded to the maximum extent permitted by law. In addition to any compensation for damage to property referred to below, You shall indemnify RHV against all losses, actions, costs, claims, damages, demands, expenses and liabilities whatsoever RHV may incur, either at common law or by statute, in respect in respect of any loss or damage (other than as a result of any negligence or default of RHV) which shall have occurred as a result of You or the Your guests' use of The Village or which shall otherwise be attributable to the acts or omissions of You or Your party.

Selected Eateries & Activities

Some of the eateries and activities within The Village are operated by third parties and You are therefore entering into a separate contract for those services with that provider when acquiring their services. Any concerns regarding Your experience with these providers should still however be directed to RHV for information purposes in addition to the provider of those services.

Day Passes

RHV day passes are issued to each guest staying in self catering accommodation on arrival with any replacement passes charged at £10 per person.

Friends or Family Joining You?

Day passes for visitors can be purchased at £18 per adult and £9 per child (up to the age of 16yrs), subject to availability - details are available from our sport and leisure complex Telephone 01772 682 000 for further details.

Car Parking & Driving in The Village

All vehicles must be parked in designated parking areas. There is parking for 1 car outside Your accommodation. Additional parking is however available within The Village. The White House and The Coach House have parking for 4 vehicles and Villanova has parking for 3 cars, within their own private grounds. RHV's parking areas are not supervised, so before leaving Your vehicle please remove Your possessions and ensure that it is fully secured. RHV does not accept liability for loss or damage to Your vehicle or for any items left inside which are lost damaged or stolen. At all times You must give way to pedestrians, cyclists and horses and keep to the left and within the 10mph speed limit.

Power Scooters / Go-Peds

With the exception of RHV's organised Segway sessions, the use of petrol or battery powered scooters, hoverboards and electric skateboards is strictly prohibited within The Village.

Children's Supervision, Carers & Parental Responsibility

You are responsible for the supervision of all members of Your party under the age of 21, this is particularly important when staying in accommodation situated close to open water. When swimming You must ensure You comply with the following adult to child ratios: 1 adult to 1 child under 4yrs old; 1 adult to 2 children 4 - 7yrs old; 1 adult to 4 children 8 -12yrs old. Carers must also ensure that all members of their party requiring care are supervised at all times.

Child Protection

RHV must follow procedures, which are laid down by the government for protecting children. In certain circumstances RHV must make contact with the Local Social Services Office and share its concerns and RHV reserves the right to do so in respect of any member of Your party without Your permission. RHV places the welfare and protection of children above all other considerations and it is its policy to seek to safeguard the welfare of children and others involved in its activities by protecting them from physical, sexual and emotional harm. There area number of measures in place throughout The Village to try to ensure that this happens. For further details please ask for a copy of RHV's child protection policy statement. CCTV: RHV does use CCTV throughout the Village for the safety and protection of its guests and staff and by placing a booking you acknowledge that You are likely to be captured on RHV's CCTV coverage and agree to RHV's use of it for these purposes without any liability to You.

Pets

With the exception of hearing and guide dogs, RHV does not allow pets onto The Village. Failure to comply will result in this Contract being terminated and no refund will be offered. Please notify RHV at the time of booking if You require to bring a hearing or guide dog during Your stay.

Damage to Our Property & Compensation

Your accommodation is thoroughly cleaned before Your arrival, however if You require additional cleaning during Your stay, there will be an extra charge incurred. You must use RHV's accommodation and facilities with care. On departure You must leave Your accommodation in a reasonably clean and tidy condition as You found it. RHV reserves the right to invoice You (or recover the cost from the payment details which You provided upon payment of the charges to RHV) for the cost of remedying this breach should You not comply. You shall indemnify RHV, keep RHV indemnified and hold RHV harmless for losses or damage to any property belonging to RHV caused by You or members of Your party and RHV reserves the right to invoice You for the cost of making good any such damage or the replacement of any property. You must inform reception during Your stay of any breakages using the honesty envelope provided, or by calling into the holiday guest reception.

Health & Safety

You shall be responsible for ensuring that the members of Your party and any day guests comply with all regulations concerning licensing, fire safety and health and safety and shall comply with reasonable requests of RHV's employees.

First Aid, Medical Assistance & Clinical Waste

Each department can provide first aid but NOT medical assistance. You must dispose of any clinical waste in accordance with instructions provided in the Information Guide found in Your accommodation. In the case of emergency You MUST call the emergency services.

Linen & Towels

All bed linen, duvets, pillows and towels are provided. If You require a change of bed linen, or towels, or Your accommodation requires servicing during Your stay there is a charge for each service.

Messages

Limited facilities exist for taking messages. RHV will do its best to assist, but cannot guarantee and takes no responsibility for the delivery or time of delivery of messages. You are responsible for checking at reception for any incoming messages, and visitors.

No Smoking Policy

By law, smoking is not permitted in any type of accommodation or any facility. RHV reserves the right to fine You £150 for breach of this clause by You or any of Your party. In the event that RHV receives a fine or penalty for Your or a member of Your party's breach of this clause then You shall indemnify it against such fine. RHV reserves the right to invoice You (or recover the cost from the payment details which You provided upon payment of the charges to RHV) for the cost of remedying such a breach of this Contract.

Energy Efficiency

RHV works hard to improve energy efficiency and reduce its carbon footprint and asks its guests to respect its objectives and switch off lights and electrical appliances if they are not needed.

Recycling Policy

RHV requests that all guests recycle their waste during and after their stay. Details are provided in the Information Guide found in Your accommodation.

General Information

Deliveries from external suppliers to The Village are not permitted. RHV is not responsible for any matter not brought to its attention during Your holiday. Any reported matter which has not been resolved during Your holiday or within 14 days of Your departure should be referred in writing to the Guest Services Manager, Ribby Hall Village, Ribby Road, Wrea Green, Lancashire, PR4 2PR.

Brochure Accuracy

Whilst RHV has taken all responsible steps to ensure that the information contained in its brochures, leaflets and advertisements is correct RHV reserves the right to alter, substitute or withdraw any service or facility without notice if necessary. RHV shall not be bound by any descriptions prices or other information set out in any such advertising or literature except that nothing in this clause shall effect RHV's liability for fraudulent misrepresentations.

Generally

Where "You" comprises more than one person the obligations and liabilities of that party under these Terms shall be the joint and several obligations of those persons. RHV shall be released from its obligations and have no further liability to You in the event of national emergency, war or prohibitive governmental regulations or if any other cause beyond its reasonable control including the actions of its subcontractors, suppliers or agents and which shall render performance of this Contract impossible. In addition to any other rights RHV may immediately terminate the Contract without liability for compensation or damages if You or any member of Your party breach the Contract. RHV may also terminate the Contract for any reason without liability for compensation or damages by giving You 6 weeks' prior notice in which case RHV shall return to You the Deposit. Any notice given pursuant to this Contract shall be in writing and shall be sufficiently given to any party if sent in a letter by first class or prepaid post addressed to that party at the party's address set out in these terms, the Acknowledgement, the booking or the Reservation Form (or any alternative address notified by that party in accordance with this clause) or delivered by hand to such address and any notice so given shall be deemed (unless the contrary is proved) to have been effected at the time at which the letter would be delivered in the ordinary course of post or hand delivered. The Contract shall not be assigned or transferred by You. The Contract constitutes the entire agreement and understanding between RHV and You and supersedes, cancels and nullifies any previous agreement between them. No representation made by RHV employees shall be incorporated into this Contract. Any person who is not party to this Contract shall have no rights under the Contracts (Rights of Third Parties) Act 1999. If any provision of the Contract is found by any Court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity shall not affect the other provisions of this Contract, which shall remain in full force and effect. This Contract shall be governed and construed in accordance with English Law and each party submits to the non-exclusive jurisdiction of the English Courts.
