Definitions
In this Contract the following words and expressions have the following meanings unless inconsistent with the context: “The Acknowledgement” means the written confirmation of your booking provided by RHV (Ribby Hall Village) to you in writing (either by post or email); “The Client” or “You” means the person(s) named as the client on the Acknowledgement; “The Contract” means the contract between RHV and You comprised of these terms and conditions, and official website, any promotional literature You have sought to rely upon at the time of booking and the Acknowledgement; “The Deposit” means the non refundable sum paid by You at the time of booking. “RHV” or “We” or “Us” means W&G Harrison Limited trading as RHV (Company Number 01032929) whose registered office is at Ribby Hall Village, Ribby Road, Wrea Green, Lancashire, PR4 2PR; “The Village” means RHV and all its grounds, owned by RHV. The headings in these Terms are for convenience only and shall not affect their interpretation.
The Contract
No contract exists between You and RHV until RHV is in receipt of Your Deposit and RHV has issued the Acknowledgement. At this time there is a legally binding contract between You and RHV. The Contract applies to Your stay at The Village. Every member of your party must comply with the terms of the Contract and all appropriate laws and bye-laws and You shall be responsible for any breaches of the Contract or such laws by any members of the party, whether they are staying at The Village or are day guests. The Spa Hotel welcomes guests aged 18 years and over only. We reserve the right to cancel your booking or instruct you or your party to leave The Village immediately, without compensation or refund, should you or any member of your party not comply with the terms of the Contract.
Prices and payment
All tariffs are inclusive of VAT which will be charged at the applicable rate. A Deposit of £75 is required to secure your booking. Deposits can only be made by credit, debit cards, or RHV vouchers. Should you decide to pay by credit card an additional 2% of each transaction will be charged. Payment of the balance of the Holiday Price in full is required no later than 6 weeks before your arrival. Please note that reminders will not be sent. If the balance of the Holiday Price is not received in full at least 6 weeks prior to your arrival, we reserve the right to terminate the Contract and treat your booking as cancelled without further notice to you. The Deposit will not be refunded. Balances paid by cheque must be made payable to ‘Ribby Hall Village’. Post-dated cheques are not a valid means of payment. For reservations made within 6 weeks of arrival, payment of the Holiday Price is required in full at time of booking. Anything bought during your stay, must be paid for prior to your departure.
Arrival and departure
Your room and entrance into the Hydro spa (packages only) are available from 2pm on the day of arrival. Your room must be vacated by 11am on the day of departure. You are however welcome to pre book any treatments or meal reservations prior to your check in time and following your check out time until 4pm.
Amending your booking
Please call us immediately quoting your booking reference number if you wish to amend your booking. We will use our reasonable endeavours to make the necessary amendments to your booking and if we are able to do so we will forward you a revised confirmation letter. We reserve the right to charge a standard £25 administration fee per booking change. Where we are unable to amend your booking and you wish to cancel your reservation, the Deposit is not refundable.
Our right to decline
We reserve the right to ask for information about any member of your party including age, name, email, tel. no. and address details. If you or a member of your party has had an infectious or contagious medical condition within 4 weeks of your stay, or during your stay you may also be asked to refrain from partaking in certain activities or you may be asked to leave RHV, should we see fit to protect the health of other guests and staff. The company reserves the right to refuse admission, or to deny the continued occupation of any type of accommodation, for whatever reason, at its sole discretion, provided we are acting reasonably, and without prejudice to the company’s rights to retain sums that have been paid.
Behaviour and compliance with this agreement
Your behaviour should not be excessive, noisy or disruptive. Offensive or illegal behaviour will not be tolerated, and could lead to your eviction and police involvement. You must show consideration for your neighbours and other guests. We reserve the right to recover from you any compensation we may pay to other guests as a result of your actions. No refunds or compensation will be given to you in these circumstances and we reserve the right to refuse any future bookings from you or a member of your party.
Cancellation
Spa breaks - The deposit is a booking fee, which will be forfeited if a booking is cancelled. Under no circumstances will the deposit be refunded or transferred in the event of the booking being cancelled after the balance of the spa break price has been paid, no part of the spa break price will be refunded. Other than in circumstances in which we are entitled to treat your booking as cancelled, all cancellations must be put in writing and notified to us immediately. Our prices do not include cancellation insurance cover. We advise you to take out your own personal cancellation insurance.
Treatments - We require 24 hours notice to cancel or amend individual treatment bookings.
To secure a pamper package, or a number of individual bookings, a non-refundable
deposit is required. Unfortunately, if treatments are cancelled without 24 hours
notice, the entire treatment fee will be charged.
Group Bookings - For groups of three or more, full payment (non refundable) is required four days prior to the appointments.
Special requirements and disabilities
We welcome guests with restricted mobility, a disability, and medical or particular care requirements. We aim to ensure that our services are as accessible as reasonably possible so it is important that we are fully aware of any needs, requirements and conditions. You must therefore provide details of such needs and requirements prior to our issuing the Acknowledgement. Before confirming your booking we will discuss with you availability, suitability and potential reasonable adjustments, including any requirement for a guest to be accompanied by someone who is able to provide any particular needs they may have over and above any reasonable adjustments we are able to make. A risk assessment may also be required prior to confirming a booking or allowing participation in certain leisure activities. We rely on the information you provide to help us anticipate and satisfy your needs. You must therefore update us with any change in circumstances prior to and during your stay. Standard Wheelchair access only is available in our accommodation.
The media
Members of the press or media are not to be invited onto The Village premises without express permission of a member of RHV’s marketing department. You may not use photographs of our staff without the written consent of RHV.
Filming and photography
We do not allow any filming or photography in or around the swimming pools and changing areas. We sometimes take photographs & film for promotional & training purposes which may take place during your stay.
Data protection
Information provided when booking will only be used by RHV. We will not pass your details to any third parties. We reserve the right to provide you from time to time with details of new facilities or special offers by post. Care of your possessions
RHV will not be liable under this Contract for loss of or damage to any property belonging to You or your guests whilst such items are at The Village. It is your responsibility to arrange suitable security and ensure insurance cover is in place for all items belonging to you or your guests for the period that such items are at The Village.
Fishing
In order to fish at The Village, those over the age of 12 years must hold a valid fishing licence and present it to a RHV representative upon request. For guests wishing to fish at our main pond, Fisherman’s Reach, passes are available to purchase on arrival at - £7 per day; £15 per weekend or midweek break; and £25 per full week. To preserve the ecology of the ponds we do close them in rotation to ensure a continued healthy and vibrant fish population. We do not therefore guarantee that all fishponds will be available for use during your stay. In addition our Fisherman’s Reach pond closes annually. Closure dates are: Nov 2010 -1 Feb 2011 & 1 Nov 2011 – 1 Feb 2012.
Liability
Nothing in the Contract shall exclude or in any way limit RHV’s liability for fraud, or for death or personal injury caused by its negligence, or any other liability to the extent such liability may not be excluded or limited as a matter of law. Subject to this RHV’s maximum aggregate liability under or in connection with the Contract, whether in contract, tort (including negligence) or otherwise, will in no circumstances exceed the total remuneration payable to RHV for your holiday. Further, RHV will not be liable under the Contract for any special, indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise, whether or not such loss or damage is foreseeable, foreseen or known. The Contract states the full extent of RHV’s obligations and liabilities in respect of your holiday and you agree that any condition, warranty, representation or other term concerning the holiday which might otherwise be implied into or incorporated in the Contract, whether by statute, common law or otherwise, is excluded to the maximum extent permitted by law. In addition to any compensation for damage to property referred to below, You shall indemnify RHV against all losses, actions, costs, claims, damages, demands, expenses and liabilities whatsoever RHV may incur, either at common law or by statute, in respect of personal injury to or the death of any person, or in respect of any loss or destruction or damage to property, (other than as a result of any negligence or default of RHV) which shall have occurred as a result of You or the your guests’ use of any of the services or facilities provided by RHV or which shall otherwise be attributable to the acts or omissions of You or your guests as a result of any breach of this Contract by You.
Selected eateries & activities
Some of the eateries & activities are operated by third parties and you are therefore entering into a separate contract for those services with that provider when acquiring their services. Any concerns regarding your experience with these providers should still however be directed to the Guest Services Manager in addition to the provider.
Car parking & driving in The Village
All vehicles must be parked in designated parking areas. Our parking areas are not supervised, so before leaving your vehicle please remove your possessions and ensure it is fully secured. We do not accept liability for loss or damage to your vehicle or for any items left inside. At all times give way to pedestrians, cyclists & horses, keep to the left and within the 10mph speed limit.
Power scooters / go-peds
The use of petrol or battery powered scooters is strictly prohibited within The Village.
Child protection
Our environment like others must follow procedures, which are laid down by the government for protecting children. In certain circumstances we must make contact with the Local Social Services Office and share our concerns and we reserve the right to do so. This information may be supplied without reference to you. RHV places the welfare and protection of children above all other considerations. It is the policy of RHV to seek to safeguard the welfare of children and others involved in its activities by protecting them from physical, sexual and emotional harm. There are a number of measures in place throughout The Village to try to ensure that this happens. For further details please ask for a copy of our child protection policy statement.
Pets
With the exception of hearing & guide dogs, we do not allow pets. Failure to comply will result in a booking being terminated and no refund will be offered. Please notify us at the time of booking if you intend on bringing hearing or guide dogs during your stay.
Damage to our property and compensation
You must use our accommodation and facilities with care. On departure you must leave your accommodation in a reasonably clean and tidy condition. We reserve the right to invoice you for the cost of remedying this breach should you not comply. You will be liable for loss of or damage to any property belonging to RHV caused by you or members of your party or guests and we reserve the right to invoice you for the cost of making good any such damage or the replacement of any property.
Health and Safety
You will ensure the members of your party and any day guests comply with all regulations concerning licensing, fire safety and health and safety and shall comply with reasonable requests of RHV’s employees.
First aid, medical assistance & clinical waste
Each department can provide first aid but NOT medical assistance. You must dispose of any clinical waste in accordance with the instructions provided in your welcome guide upon arrival.
Messages
Limited facilities exist for taking messages. We shall do our best to assist, but cannot guarantee delivery or time of delivery of messages. You are responsible for checking at reception for any incoming messages, and visitors.
No smoking policy
By law, smoking is not permitted in any type of accommodation or any facility.
Energy Efficiency
We work hard to improve our energy efficiency and reduce our carbon footprint on the environment and we would ask our guests to respect our objectives and switch off lights and electrical appliances if they are not needed.
General Information
Deliveries from external suppliers are not permitted. We are not responsible for any matter not brought to our attention during your holiday. Any reported matter which has not been resolved during your holiday or within 14 days of your departure should be referred in writing to the Guest Services Manager, Ribby Hall Village, Ribby Road, Wrea Green, Lancashire, PR4 2PR.
Generally
Where “You” comprises more than one person the obligations and liabilities of that party under these Terms shall be the joint and several obligations of those persons. RHV shall be released from its obligations and have no further liability to You in the event of national emergency, war or prohibitive governmental regulations or if any other cause beyond its reasonable control shall render performance of this Contract impossible. In addition to any other rights RHV may immediately terminate the Contract without liability for compensation or damages if You breach the Contract. RHV may also terminate the Contract for any reason without liability for compensation or damages by giving You 6 weeks prior notice. Any notice given pursuant to this Contract shall be in writing and shall be sufficiently given to any party if sent in a letter by first class or air mail prepaid post addressed to that party at the party’s address set out in these terms, the Acknowledgement or the Reservation Form (or any alternative address notified by that party in accordance with this clause) or delivered by hand to such address and any notice so given shall be deemed (unless the contrary is proved) to have been effected at the time at which the letter would be delivered in the ordinary course of post or hand delivered. The Contract shall not be assigned or transferred by You. The Contract constitutes the entire agreement and understanding between RHV and You and supersedes, cancels and nullifies any previous agreement between them. No oral representation made by RHV employees shall be incorporated into this Contract. Any person who is not party to this Contract shall have no rights under the Contracts (Rights of Third Parties) Act 1999. If any provision of the Contract is found by any Court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity shall not affect the other provisions of this Contract, which shall remain in full force and effect. This Contract shall be governed and construed in accordance with English Law and each party submits to the non-exclusive jurisdiction of the English Courts.
Availability
Whilst we endeavour to ensure that all aspects of the Spa and Aqua Thermal Journey are in full working order at all times, inevitably on some occasions some facilities may not be available. In these circumstances RHV will not be held responsible for providing discounts to compensate for out of service facilities.
